Terms of Service
By contacting me in any way to apply or purchase my services, you've agreed and accepted all of the following terms.
I will not be held responsible for any misconception if you do not read my TOS thoroughly.
COPYRIGHT
• Purchasing digital art or service from me means I retain full copyright of the art, assets, and editable files. Each commission is for personal use only (non-commercial).• You can stream or make monetized content using the commissioned model. If you plan on reselling the art in the form(s) of merchandise/animation, there is an increased fee for redistribution rights/royalties.• The sale includes the right to use the model (including live streaming and video production), but it is prohibited to use the original artwork of this model to produce physical merchandise.• Commercial rights and merchandise royalty fees (%) will be discussed and agreed upon under a legal contract. You must contact me beforehand if you plan to resell my work. You cannot sell or re-distribute commissioned work for profit unless discussed.
CREDITS
• Credit me in your bio, description, and post when using or displaying my work. Use @Seraphvina in your twitter bio or link my website.• My name must be easily seen and accessed. Kindly inform this rule to your animator, rigger, or any 3rd parties that use my work.• Do not remove my watermark. The artist will place it where it is easily seen in a way that does not deter our appreciation of the artwork.
GENERAL
• All progress will be showcased on my social platforms through images and videos (Twitter, YouTube, Twitch, etc...) showcases with credited names will be up to the client.Commissions can be kept private but will be charged twice(x2) the total amount. After 1 month, non-compromising details (small teasers: rigging details like eye physics, clothes physics, etc.) will be revealed only for advertising purposes.• I, the artist, have the right to decline any commission at any time.• You will receive the .moc3 runtime files to use your model. I do not provide the editable raw files.• Cropping, editing, changing, using my work, or removing watermarks without permission is prohibited.• I will not change my style based on your request, or replicate work from another artist.• I will not accept commissions I am not comfortable with, or if it does not fit my style.• No pressuring/backseating. Do not request for deadlines or put stress on me while I work.• You understand that my priority is to provide the highest quality work. Commissions may take days to months based on complexity and waitlist.• For model upgrades or special requests, kindly contact me so I may provide a quote. Keep in mind that I don't accept every new request.• I DO NOT consent to anyone using my work in blockchain-related technology, Ai training, crypto, or NFTs.
PROCESS
• Contact me through Dms or by applying in the Google form with all information necessary attached.• All references must be provided in a reference sheet, or 1 image file before I begin and decide to accept the commission. Use simple words or labels.• I allow 2 minor revisions. Each new revision will cost extra depending on time taken to complete.• Updates will be sent to you through pictures(.jpeg/.png), videos(.mp4), or a stream link format.• You will receive the .moc3 runtime files to use your model. I do not provide the editable raw files.• You, the client, are required to provide feedback when I ask questions about your commission.• After confirming you are satisfied with the result, I will send all of the necessary files in a WeTransfer link.
PAYMENT
• 100% Payment upfront for illustrations.• 50% Payment required upfront for Live2D Models and Rigging waitlist.• Payments are completed using Paypal invoice. Invoice will come with a 12% transaction fee.• I will only send your files using a WeTransfer link after the full payment is paid.• No refunds.
USAGE RULES
• The user is responsible of saving their own copy of the run-time files. All files are delivered in a 7-day download link. Requesting another copy will incur a fee each time.• The model can be modified or adapted, but any modifications that are insulting in nature are prohibited.• The artist and rigger are not responsible for any negative impact on society or any legal violations caused by the user's use of the artwork or model.• Search for software usage methods independently as I do not provide in-depth teaching services. I recommend face-tracking programs like VtubeStudio and Vbridger. Personal tutoring for basic model set-up will incur a fee.• The artist or rigger will not be held accountable for the model's performance due to the user's lack of knowledge (including but not limited to: VtubeStudio parameter settings, VBridger parameter settings, facial tracking camera used and improper facial lighting) when piloting the model.• The user will be held accountable for any modifications or changes requested over the artist and rigger's work that may affect the illustration's result or model's performance. Seek guidance and recommendations from the artist or rigger before requesting changes towards ongoing progress.
